The Crime of killing innocent Muslims

Shaykh Abdul Baaree Ath Thubaytee [(Rabee'ul Awwal 11, 1425 (April 30, 2004)]

 

All praise is due to Allaah, Lord of all the worlds. Peace and blessings be upon the Messenger, his household and companions.

Fellow Muslims! The Muslim is saddened and baffled when he sees the affliction with which we are visited and the sinful attacks carried out by a deranged and erroneous group. Certainly, Islaam condemns these acts whoever its perpetrator may be and however his excuses may be. For, these acts have caused many huge corruptions and evils. Among them which is killing innocent Muslims unjustly and aggressively. Allaah says,

"Whoever kills a soul unless for a soul or for corruption [done] in the land – it is as if he has killed mankind entirely."

(Al-Maaidah 5:32)

Allaah also says,

"Whoever kills a believer intentionally – his recompense is Hell, wherein he will abide eternally, and Allaah has become angry with him and has cursed him and has prepared for him a great punishment."

(An-Nisaa 4:93)

The Messenger of Allaah said, "A faithful believer remains at liberty regarding his religion unless he kills somebody unlawfully." (Ahmad and Al-Bukhaaree)

The Messenger of Allaah also said, "The annihilation of this world is less important to Allaah than killing of a Muslim man." (At-Tirmidhee)

When Usaamah ibn Zayd killed a man using his personal reasoning after he had heard uttering the statement of testimony, the Messenger of Allaah reprimanded him saying, "Did you kill him after he had said: 'Laa ilaaha illallaah'?!"

In another hadeeth, the Prophet said, "The greatest of the major sins is to ascribe partners to Allaah in worship and killing [innocent] soul." (Al-Bukhaaree)

These bomb attacks in which many Muslims were killed have no basis in the religion of Islaam and no sane or natural person will accept any justification for them. They are heinous acts that bore aggression and injustice.

Brethren in faith! It is not a characteristic of a believer to bomb himself, kill others, waylaid the Muslims, threaten them with weapons or hijack their cars. These are certainly characteristics of high-way robbers who cause mischief in the land.

Allaah's Messenger said, “Whoever kills himself with a steel [weapon] will have the weapon in his hand and will continue stabbing it into his stomach in the Fire of Hell forever and ever. Whoever kills himself by drinking poison will sip it in the Fire of Hell forever and ever. Whoever kills himself by jumping from a mountain will keep throwing himself [off a mountain] in the Fire of Hell forever and ever.” (Muslim)

In these acts, there was an act of carrying weapons against the Muslims. Al-Bukhaaree reported on the authority of Aboo Hurayrah that Allaah's Messenger said, "None of you should point out towards his Muslim brother with a weapon, for he does not know, Satan may tempt him to hit him and thus he would fall into a pit of fire (Hell)" (Al-Bukhaaree)

Muslim reported that the Prophet said, "Whoever points a weapon towards his brother will be cursed by the Angels until he puts it down, even if he is his brother from the same father and mother." (Muslim)

These acts also implied going against the community of the Muslims and causing disunity among them. And this is a major sin. Allaah's Messenger said, "Whoever disobeys the ruler and separates from the company of the Muslims and dies [in that situation], his death will be like that of the time of ignorance." (Muslim)

He also said, "Whoever separates from the community of the Muslims even for a span, he has hurled himself out of the fold of Islaam." (Ahmad and Aboo Daawood)

These acts also include attacking security men. This is a great crime because they are Muslims and the Muslim, according to Islaam is forbidden from being killed or attacked. There is also no disagreement on the fact that innocent souls should not be killed whatever their sins and mistakes may be. Killing of these souls is therefore not reform, for can causing mischief and risking the lives of innocent people and playing with the security of the society be called reform? Those who call to Jihaad without considering the consequences of killings are certainly oblivious of the noble and lofty purpose for which Jihaad is ordained. The Jihaad is ordained to establish the religion and raise the banner of Tawheed, because whenever killing leads to fitnah it becomes prohibited by Islaam and common sense.

These acts create terror and fright in the hearts and cause anarchy. And frightening Muslims is unlawful.

These heinous acts can cause internal crises that may destroy energies and valuables and render efforts in vain. They can impede good and development and put clog in the wheel of reform.

Exposing the security of the society to negligence can destroy the society and its achievements. That is why it is incumbent on us to exert all efforts in preserving this security by blocking all ways that could create weakness in this society and thereby prevent it from carrying out its message and obligations.

The glorious Qur'aan explains that a characteristic of the hypocrites is shaking the security of their society, causing mischief therein and spreading fitnah under the guise of reform. Allaah says,

"And when it is said to them, 'Do not cause mischief in the earth,' they say, 'We are but the reformers.' Unquestionably, it is they who are the corrupters, they perceive not."

(Al-Baqarah 2:13-14)

Brethren in faith! It is when the society lives under the shade of security that the sweetness of worship is achieved. It is then that sleep in the night can be a rest, that food and drink can be enjoyed. Security is the pillar of all human effort and a fundamental pursuit for all people especially in Muslim societies that enjoy faith. For, there is no security without faith. Allaah's Messenger said, "Whoever among you wakes up in the morning feeling safe among his herd, sound in his body and having his daily food, it is as the entire world is put in his possession." (at-Tirmidhee)

It is with security that mosques are visited, prayers are established, honours and properties are protected, ways are secured, good things are spread, Islaamic legal punishments are implemented, call to way of Allaah is spread and the law of Islaam is put into practice.

If there is defect in security, thieves and high-way robbers become masters. In the absence of security, people live in fear and disunity. Even some deluded individuals can be used against their society.

This country like others is undergoing a dangerous stage. We should therefore stand united in wishing each other well, enjoining good, forbidding vices and working towards reform and reconstruction and not destruction.

Let every one feel the sense of obligation towards preventing this society from decaying. Big crises that rocked past nations started from minor things that were treated negligently by the scholars and the wise people among them. It was this negligence that turned the entire land into an incontrollable hell. The security of individual is a part of the security of his society and consolidation of societal security demands that each person fulfil his obligation in maintaining the security. The Prophet said, "Every one of you is a shepherd and every one of you will be held responsible for each flock." (Al-Bukhaaree and Muslim)

Fellow Muslims! The heinousness of this crime is vivid. How could the perpetrators of this crime fail to recognize the texts of the Qur'aan and the Sunnah and instead killed innocent souls, bereaved many and caused injury to all Muslims?

How are they going to answer for the blood of Muslims that they shed and their limbs that they scattered, a situation that has gladdened the enemies of Islaam and caused an internal scar on the Muslim society?

The Ummah is undoubtedly experiencing throughout the world. How then could some of us unjustifiably create the fire of crises internally? Those who are going to benefit from this are certainly the enemies who always lie in wait for us. The Ummah groans in pain and feels the enormity of the affliction when this affliction is caused by some of its own. The history of Islaam however revealed that the most prominent afflictions by which this Ummah was visited were caused from within by those, "whose effort is lost in this world life, while they think that they are doing well in work", "those who cause corruption in the land and do not amend."

The Muslim youths should have sure knowledge of their religion. They should seek useful knowledge. Let who have committed errors return to Allaah in repentance, for the one who repents from a sin is like someone who has no sin.

Brethren in Islaam! Of the greatest causes of calamities and crises are sins. Sins remove blessings and bring afflictions. It is therefore our obligation to return to Allaah in repentance. Allaah says,

"And whatever strikes you of disaster – it is for what your hands have earned."

(Ash-Shooraa 42:30)


If the Ummah really wants peace and security, it should fear Allaah and seriously remain upright and obey Allaah and His Messenger.

The effective protection of our youths lies in implanting Islaam's moderation in their hearts and teaching Islaamic education in schools, universities and mosques. The deviant ideologies – both extremism and negligence – should be cast away. Accusing fingers should not be pointed at anyone without proof and deliberateness. No generalization should be made and casting doubt on the centers of Da'wah and reform should stop.

We pray that Allaah preserve for us our security, faith, peace and Islaam. We beseech him to protect us from apparent and hidden fitnahs.

Fellow Muslims! Our brethren in Fallujah, rather in Iraq and Palestine, are living in a very difficult situation exemplified by killings, destructions and genocide. What is the sin of these people? When will this massacre and war stop? When will the children live in happiness and when will the women live in security? The aggressors have exceeded all limits, hurled away all modesty and destroyed almost everything. Where is the much publicized freedom under the false banner of which they are subjugating other people and occupying their lands? Where is the justice in whose name they are causing mischief in the land? Where are the human rights of the person they kill and persecute? Where are the international pacts? Is there any law that can justify for them their crimes for which the earth shakes and the heaven weeps and for which people were terrorized?

It is as the world of today has removed the concept of mercy, love and compassion from its dictionary. Injustice and arrogance have reached their cruelest stage in this age. Worldly interests are the basis of all actions and inactions even all values and excellence principles have to be sacrificed, and even if these interests have to be achieved at the expense of killing children, women and worshippers. We ask Allaah to give Muslims safety and wellbeing.

Nevertheless, this Ummah will never be annihilated however great its calamities are. The night will soon give way to a bright dawn with its lights.

We are therefore calling on those who still some particles of mercy in their hearts let alone those in whose hearts milks of mercy still run abundantly, to all they can in removing this injustice and reining in the aggressors who persist in their aggression, belligerence and arrogance.
